U.S. Supreme Court rebukes City of Chicago over Gun Ban

The Federal Supreme Court of the U.S.A. on June 28, 2010, promulgated its decision in the case of Otis Mcdonald, et al, vs. City of Chicago, Illinois et al. Voting 5-4 and with the majority opinion penned by Associate Justice Samuel Alito, the Court ruled that the Second Amendment right to keep and bear arms for self defense is fully applicable to the states through the Fourteenth Amendment (due process clause) remanding to the Seventh Circuit  Court in Chicago to resolve conflicts between the second amendment and the gun ban imposed by the said city. It reversed the earlier decision of the Seventh Circuit Court and the Court of Appeals dismissing the petition of retiree Otis Mcdonald to overturn a handgun ban and other aspects of gun registration regulations affecting rifles and shotguns in Chicago, Illinois. United States Supreme Court issues historic decision in favor of Gun Owners

In a great victory for the National Rifle Association (NRA), the United States Supreme Court has ruled yesterday in the long awaited case of Mcdonald vs. City of Chicago, that the right to keep and bear arms in the 2nd Amendment right of the U.S. Constitution applies equally to states and cities as well as to individuals. Last year, the U.S. Supreme Court likewise decided in favor of the NRA by ruling in Heller vs. Washington D.C. that the right t keep and bear arms is an individual right. MAMANG PULIS -- ONLY one Permit-to-Carry-Firearm Outside of Residence (PTCFOR) will be issued by the Philippine National Police to licensed gun holders this time.

The “one PTCFOR policy” will be part of the much tougher gun control program in the country designed to arrest gun-related violence. Under the same policy, a PTCFOR will be issued to a licensed gun holder provided he or she complies with nine strict requirements, PNP spokesman, Chief Supt. Leonardo A. Espina said.

Espina said PNP chief, Director General Jesus A. Verzosa decided that a PTCFOR will be issued only for a handgun. “Those in possession of automatic rifles and machine pistols will not be given a PTCFOR,” he explained.

Salvaging and Summary executions revisited

The suspicious shooting of the suspectsed robber-killer of a seaman again raises questions regarding police summary executions or salvaging. This week suspect Ronald Sevilla was shot dead while in police custody as he was being transferred from the Police Precinct 4 of the Manila police to the City Hal Prosecutor's Office for inquest proceedings. Sevilla purportedly bore three bullet wounds in the head, while handcuffed. The reason given by the poilcemen escorts was that Sevilla was shot while trying to escape.After decades of problems of this sort, we have still not resolved the problem of police summary executions or salvaging. But the matter seems all the more reprehensible when it is committed in broad daylight in the heart of a capital city, right in the shadow of the City hall. Ironically, "salvaging" literally means to "save", which adds insult to injury when used to describe summary killings of suspects. Continue Reading

Good Samaritans with Guns. Is it advisable?

 On a summer night in 1963, a young girl named Kitty Genovese was stabbed and beaten to death on a residential street in New York City while 200 bystanders stood by and watched. They did nothing. This incident sparked an outrage in the U.S. and the public immediately had an outcry against people who "did not want to get inolved."Were these bystanders really cold and callous and uncaring? Many thanks to our Gun Ban Crimes Project volunteers! I have now updated the statistics pages with a listing of the users who volunteered their time. Your efforts have played a valuable role in the opposition to PNP's proposed extended gun ban. It is difficult to dispute those figures which were gathered from public independent sources and openly available to peer review. The results will also provide a useful addition to our armory of evidence to fight future bans. The 2010 Election ban may be officially over but the anti-gunners won't ever stop pushing their gun control agenda.
