Robbery suspect Jeromy Polistico was eating lunch with his lawyer Jesus Feliciano in front of the Bagong Buhay Rehabilitation Center (BBRC) in barangay Kalunasan, Cebu City when two unidentified motorcycle-riding gunmen shot him dead at noon yesterday.
The 34-year-old Polistico of Clarin, Misamis Occidental had just posted a bail of P40,000 before taking what turned out to be his last meal as a free man.
He died on the spot for gunshot wounds sustained in various parts of his body.
Polistico was one of several members of an Ozamiz-City based robbery group that was arrested by Punta Princesa police in relation to the P6.5 million jewelry robbery inside a fastfood restaurant in Cebu City last July 21.
The group comprised of Frederick Ybañez, a native of Osamiz in Mindanao, 44-year-old Noel Davis, of Glodo Subdivision, Panabo City in Davao, and 27-year-old Kirby Abnilla of barangay Suba-Pasil Cebu City are still in the jail.
They were identified by their victim businesswoman Jennifer dela Cerna, who was robbed inside the fastfood restaurant in barangay Mambaling, Cebu City.
The suspects were later arrested after being caught in a traffic jam in barangay Punta Princesa.
Polistico together with Davis, Jennifer Enriquez, Ybanez and Abanilla were charged with robbery before the Regional Trial Court.
Enriquez was released last month after posting a P100,000 bail.
Police investigation showed that the two assailants arrived near the jail’s gate past noon yesterday.
Homicide chief investigator Jay Yballe said the gunmen covered their faces with a handkerchief and approached Polistico at the table and shot him several times.
Despite his wounds, Polistico tried to run back to the gate to scream for help but fell down a few meters away from the gate.
The witnesses were unclear on where the assailtants headed. Some said the gunmen went toward barangay Guadalupe while others claimed they headed to Apas.
Supt. Efren Nemeño, city jail warden, promised to help in the investigation.
Feliciano managed to hide himself during the attack and did not see the assailants.
“Someone suddenly shouted ‘Those who are not included, lie down.’ I was praying the Our Father and waited if I will be shot too,” a trembling Feliciano recounted.
Last Tuesday, Regional Trial Court Judge Geraldine Faith Econg of branch 9 granted the petition for reduction of bail from P100,000 to P40,000 filed by Polistico.
Econg also decided to arraign Polistico before granting his release.
“These people (perpetrators) are taking justice into their hands. He was shot before he was made to answer the allegations against him. He was deprived of his rights. It’s an insult to the judiciary,” Econg told CEBU DAILY NEWS.
